(contrary to what Kavanaugh may tell the captured press - they use the shadow docket basically not just because they can't "reason" through their decisions, but that those "decisions" are in fact unsupportable by the modern Constitution and they're functionally unable to justify any of these unjustifiable decisions they make)
So - I am honestly not sure where we are exactly --
as evidenced by this mighty panel that was just named today but it's entirely unclear in the current "system" such as it is exactly what power it might have
